Danish Presidency programme for justice and home affairs

The Danish Presidency of the EU has just published its overall programme. The section dealing with justice and home affairs contains little that has not been spelt out in ongoing Action Plans etc, but of note are the following objectives:

- "systematic evaluation of third countries' contribution to the fight against terrorism"

- "introduction of anti-terrorism clauses in agreement with third countries"

- "new instruments for combating terrorism", including: "Concluding cooperation agreements with the USA on extradition and mutual legal assistance in criminal matters" (Note: this extends way beyond "terrorism")

- "simpler access to exchange of information between police and public prosecutors etc.. particularly as regards fingerprints and details of previous criminal records"

- mutual recognition of court judgements in each member state, including fines and asset confiscation orders and "disqualifications"

- "alignment" of laws across member states including information technology crime, racism and xenophobia and corruption in the private sector

- "follow up the Commission's Green Paper on a Community return policy on illegal residents" plus conclusion of readmission agreements being negotiated, ensuring that "all future cooperation and association agreements concluded by the EU contain a clause on joint management of migration flows and readmission of illegal immigrants" and "the possibility of taking steps if a third country fails to cooperate without good reason".
