Following the annulment by the European Court of Justice of the EU-US agreement on the exchange of data on air travellers ("passenger name records") officials from the European Commission and their counterparts in Washington have quickly moved to play down the significance of the ruling, suggesting that replacing the treaty with a "Third Pillar" instrument will be a mere "technicality". The European Parliament is excluded from the negotiations, as it was in 2003 when the EU agreed mutual legal assistance and extradition treaties with the United States.
