Agreed in secret by the governments of Belgium, Germany, Spain, France, Luxembourg, Netherlands and Austria (the five original Schengen states plus Spain and Austria). Their national parliaments could not change a "dot or coma" nor will the other 18 EU parliaments be able to. As the UK House of Lords observed:

"if the Convention does become part of the legal framework of the EU, that framework will for practical purposes have been imposed by seven Member States on the other eighteen"
