POLAND-GERMANY: Suspected Israeli spy subject to European Arrest Warrant

Warsaw Appeal Court authorized Polish Prosecutory Office to apply surrender procedure to Uri Brodsky, an Israeli citizen suspected of helping to forge a German passport used in connection with the murder of a Hamas commander.

Brodsky was detained by border guards at Warsaw airport on 4 June on an arrest warrant issued by a German court in Cologne for the person responsible for fraudulently obtaining a German passport used by a member of a hit squad that assassinated Hamas commander Mahmoud al-Mabhouh in Dubai last January.

The Appeal Court upheld earlier decision by Warsaw regional court. Polish Gazeta Wyborcza newspaper and German weekly Der Spiegel reported earlier that the arrest in Poland had already led to some diplomatic friction between Polish and Israeli authorities given that the Israeli embassy had urged Polish authorities not to extradite Brodsky.

Despite the "pro-European" stance of Polish courts, Brodsky's surrender to German judiciary will probably not result in charges of espionage but only of forgery, relating to false information provided by Brodsky when applying for his passport in Cologne.
