"The added value of the European Public Prosecutors' Office shall consist of having criminal investigations and prosecutions by a single and independent Office at the European level in the cases of fraud against EU funds, increased prosecutions, funds' recovery and trust of taxpayers in the European Institutions. The current system, even if working well in some Member States, proved to be rather inefficient throughout the Union in terms of prosecutions and funds' recovery."

"The Ministers' discussion at the December Council were based on the assumption is that the EPPO will be organised in such way, that the European Prosecutors will, as a rule, supervise the work of the European Delegated Prosecutors in their Member States of origin. As the Presidency considered that this approach could raise questions as regards the independence of the decision-making of the Office, it suggested, as a balancing measure, that the independence of the European Chief Prosecutor and the European Prosecutors should be reinforced through more transparent and "European" appointment procedures. A majority of Ministers there by agreed that the independence of the European Prosecutors needs to be strengthened in order to balance this mechanism of supervision within the Office, including through a more transparent and objective procedure of nomination and appointment of the Members of the College."

"The Presidency intends to conduct a complete reading of the text of the report annex. However, considering that most provisions have already been examined and analysed in depth, the discussions should a priori focus on issues which have been left partly open and/or which are of particular importance for the text. The Presidency therefore invites delegations to consider the two focal issues presented below."
The two issues highlighted are: "The monitoring and supervision of investigations and prosecutions and related issues" and "Exercise of the competence of the Office and the right of evocation"

"Under the Italian Presidency, the proposal has been discussed during 12 meeting days at expert group level, in addition to four meetings of CATS, the JHA Council in October and the informal ministerial in July. The discussions have been very constructive, but have also demonstrated that there are a number of technical issues that will need to be solved. Following these discussions, a redrafted text of the first 37 Articles of the Regulation has been elaborated, and is presented to the Council as Annex II to this document. The text still includes a number of open issues that will need further consideration at expert level."
Issues come under the heading: "some aspects regarding the independencet of the EPPO".
