"On 18 December 2014 the CJEU declared the Draft Accession Agreement incompatible with the EU Treaties on a number of grounds.... [for example] entrust a judicial review of EU actions in (some) CFSP matters - for which the CJEU has no competence - to the European Court of Human Rights (ECtHR)."
