The Council of the EU (the body representing the 12 states) has
referred the question of whether the EU can accede to the
European Convention of Human to the European Court of Justice for
its opinion. The question the Court has been asked is whether its
adoption `would be compatible with the Treaty of Rome'. Until now
some governments have maintained that an individual with a
grievance against the Council (and its associated bodies) could
not take action against it because it was not a `state'
(nationals take a case against their own states).
