Member States’ positions Fourteen of the first fifteen Member States (all except UK) have given jurisdiction to the Court; eleven of them give jurisdiction to all national courts or tribunals to send references (Ireland, France and Spain allow only final courts to refer); six of the new Member States have given jurisdiction to the Court (Hungary, Lithuania, Czech Republic, Estonia and Slovenia allow all courts and tribunals to refer; Latvia allows final courts to refer)
